1. Agreement & Acceptance
1.1. These Terms and Conditions (“Terms”) govern all electrical work, services, call-outs, and materials provided by [Sparky Stoop] (“the Electrician”) to the customer (“the Client”).
1.2. Deemed Acceptance: Issuance of a quote, estimate, or call-out booking by the Electrician and subsequent acceptance by the Client—whether via written signature, email confirmation, text message, verbal instruction to proceed, or payment of a deposit/call-out fee—constitutes full, legal agreement to and signing of these Terms and Conditions.
2. Call-Out Charges, Rates & Deposit Requirements
2.1. Standard Hourly Rate: The standard labor rate is charged at £70.00 per hour (billed in 30-minute increments after the first hour), plus the cost of any required materials.
2.2. Standard London Call-Out Fee: All non-quoted, diagnostic, emergency, or fault-finding site visits are subject to a standard minimum call-out charge of £100.00 (or up to £120.00 for emergency/out-of-hours visits). This charge covers travel and includes up to the first 60 minutes of labor/diagnosis on site.
2.3. Deposit Requirement (Jobs Over 6 Hours):

For any work or project estimated to take longer than 6 hours, a mandatory upfront deposit is required prior to the commencement of work or ordering of materials.

The deposit calculation is set at 30% of the standard 6-hour labor rate (£70/hr × 6 hours = £420 total 6-hour base labor cost), equating to a required deposit of £126.00.

Work will not be scheduled or started until this deposit has cleared in full. The deposit will be deducted from the final invoice.
2.4. Parking & TfL Charges: Any necessary parking fees, pay-and-display costs, or Transport for London (TfL) charges (e.g., Congestion Charge, ULEZ) incurred to attend the job will be added to the final invoice at direct cost.
3. Payment Terms (Strict 7 Days)
3.1. Payment Period: Final invoices issued by the Electrician (minus any paid deposit) are due for full payment within 7 calendar days from the invoice date.
3.2. Methods of Payment: Payment must be made by bank transfer (BACS) or cash.
3.3. Late Payment Interest: The Electrician reserves the right to charge interest and recovery fees on overdue payments under the Late Payment of Commercial Debts (Interest) Act 1998 (or equivalent consumer late fee regulations) at a rate of 8% above the Bank of England base rate, calculated daily from the due date until paid in full.
3.4. Retention of Title: Title and ownership of all supplied materials, fittings, and goods remain with the Electrician until the invoice is paid in full. The Electrician reserves the right to repossess unpaid materials where legally permissible.
4. Scope of Work & Qualification Limits
4.1. The Electrician holds City & Guilds (or equivalent) Level 2 and Level 3 Diplomas in Electrical Installations and the 18th Edition Wiring Regulations (BS 7671) certification.
4.2. Non-Notifiable Work Only: All work undertaken is limited strictly to non-notifiable electrical work as defined under Part P of the Building Regulations (England and Wales) (e.g., replacement of existing fittings, minor additions/alterations outside special locations, maintenance, and fault finding).
4.3. The Electrician does not undertake work requiring direct notification to Local Authority Building Control (LABC) or Third-Party Certification unless formally arranged via an accredited competent person scheme.
4.4. A Minor Electrical Installation Works Certificate (MEIWC) or electrical test schedule will be issued where required under BS 7671.
5. Existing Installations & Pre-Existing Defects
5.1. The Electrician accepts no liability for pre-existing fault conditions, safety defects, outdated wiring, or non-compliant installations discovered on the Client’s premises before, during, or after the performance of the works.
5.2. If pre-existing defects or unsafe conditions are identified, the Electrician reserves the right to pause work until the issue is rectified or to issue a danger notification. Any extra work required to bring the installation up to safe BS 7671 standards will be quoted separately. Photographs will be taken of the work site before work by Sparky Stoop would commence to keep a record of conditions.
6. Errors, Omissions, and Unforeseen Site Conditions
6.1. Errors and Omissions Excepted (E&OE): Quotations and estimates are prepared using reasonable skill and care based on information available at the time. The Electrician shall not be held liable for any minor clerical errors, typographical mistakes, or inadvertent omissions in quotes, invoices, or site descriptions.
6.2. Omissions in Client Instructions: The Electrician accepts no responsibility or liability for damages, delays, or additional costs resulting from the Client’s failure to disclose relevant structural, electrical, or site conditions (including hidden pipes, structural defects, or hazardous materials like asbestos).
6.3. If unexpected obstructions, concealed wiring, or structural impediments are discovered, the Electrician reserves the right to amend the scope of work and quote accordingly.
7. Limitation of Liability & Exclusion of Property Damage
7.1. Exclusion of Property Damage: To the fullest extent permitted by applicable UK law, the Electrician shall not be responsible or liable for any direct, indirect, consequential, or incidental loss, damage, or degradation to property, fixtures, fittings, plasterwork, decoration, flooring, or existing circuits, whether occurring during the work or at any point in the future.
7.2. Future Failures: The Electrician is not liable for subsequent electrical faults, failures, or damage arising after project completion that result from:

Pre-existing wiring or supply issues.

Misuse, overload, or unauthorized tampering/modifications by the Client or third parties.

Wear and tear, power surges, or external utility supply disruptions.
7.3. Plaster & Decoration: While reasonable care is taken during chasing or cutting, filling, re-plastering, and decorative reinstatement are excluded from the service unless explicitly stated in writing.
7.4. Statutory Exception: Nothing in these Terms shall limit or exclude the Electrician’s liability for death or personal injury caused by proven negligence, fraud, or any statutory rights under the Consumer Rights Act 2015 that cannot legally be excluded under UK law.
8. Client Responsibilities
8.1. The Client must provide safe, clear, and unobstructed access to the work area, main consumer unit, and electricity supply.
8.2. The Client must inform the Electrician of the location of all hidden service pipes, cables, and structural hazards prior to commencement.
8.3. The Client must ensure children and pets are kept clear of the workspace at all times for safety.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
10. Call-Out Charges for Uncompleted or Unexecutable Works
10.1. The standard call-out fee or minimum initial diagnostic charge (£100.00) remains fully payable in all circumstances where the Electrician attends the site, regardless of whether the physical repair, installation, or requested work can be completed during the visit.
10.2. Situations where the call-out charge remains strictly payable include, but are not limited to: a) The fault or issue originates from the supplier or Distribution Network Operator (DNO) side (e.g., blown main service fuse, incoming supply fault, or power cut). b) The existing installation, consumer unit, or wiring is unsafe, non-compliant with BS 7671, or dangerous, requiring remedial or notifiable works that fall outside the agreed non-notifiable scope or capability before the specific repair can proceed. c) Specialist parts, components, or materials are required that are not standard vehicle stock and must be ordered. d) The Client or property manager fails to provide clear access, safe working conditions, or correct access details at the agreed appointment time. e) The Client decides not to proceed with the recommended repair or quotation following initial fault assessment and diagnosis on site.
10.3. The call-out fee compensates the Electrician for travel, site attendance, operational expenses, and the application of technical expertise and diagnostic testing to identify the underlying issue which is a service itself. Where follow-up repair work is subsequently booked and undertaken by the Electrician, the initial call-out fee may be credited or deducted from the final repair invoice at the Electrician’s sole discretion.
